The Digital Millennium Copyright Act (“DMCA”) creates a standardized process for copyright holders to ask Wilson Pro Painting (collectively referred to as "we," "us," or "our") to take down allegedly infringing content hosted on our website (wilsonpropainting.ca). We respect the intellectual property rights of others and expect our users, franchisees, and crew members to do the same.

1. Accurate Information Required

The DMCA requires that you swear to the facts in your notice of infringement under penalty of perjury. It is a federal crime to intentionally lie in a sworn declaration. Submitting false information could also result in civil liability—meaning you could be sued for money damages, attorney fees, and costs incurred as a result of the false notification.

2. Investigation Prior to Submission

Filing a DMCA notice of infringement is a serious legal allegation that carries real consequences for real people. Because of that, we ask that you conduct a thorough investigation and consult with an attorney before submitting a takedown request to ensure that the use of materials isn’t actually a fair use or otherwise legally permissible.

3. DMCA Takedown Notice Requirements

If you believe your copyrighted content is being used in an unauthorized manner on our website, please send a written email notification to our designated DMCA Agent at info@wilsonpropainting.ca. Please include the following information in your notice:

  1. A physical or electronic signature (typing your full name will suffice) of the copyright owner or a person authorized to act on their behalf;
  2. Identification of the copyrighted work claimed to have been infringed (e.g., a link to your original work or a clear description of the materials allegedly being infringed);
  3. Identification of the infringing material and information reasonably sufficient to permit us to locate the material on our website (such as the specific URL page containing the material);
  4. Your contact details, including your physical address, telephone number, and an email address;
  5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  6. A statement that the information in the complaint is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

4. Counter-Notifications

If you believe your content on our site was mistakenly disabled or removed as a result of a DMCA takedown request, you have the right to contest the removal by submitting a counter-notification.

To be effective, a counter-notification must be a written communication sent to our Designated Agent containing the following elements:

  1. Your physical or electronic signature;
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled;
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
  4. Your name, address, and telephone number; and
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside of the United States, the federal courts in California), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
